These terms govern your use of the oria-marine.com website and the purchase of the Oria Box and its associated subscription. They are entered into between Oria Marine ("Oria", "we", "us") and the visitor or customer ("you"). French law applies.
1. Acceptance
Browsing the site implies acceptance of these terms. Placing an order requires explicit acceptance during the checkout flow operated by Stripe. We may amend these terms; the version in force at the time of your order applies to that order.
2. About Oria
Oria Marine is a French company (SIREN 912 632 601) headquartered at 229 rue Saint-Honoré, 75001 Paris. The full legal notice is available on the Legal notice page.
3. Product & subscription
The Oria service comprises a piece of hardware (the Oria Box) connected to your boat's NMEA network, a web dashboard, a mobile application, and 4G data connectivity. The hardware is delivered as part of a 12-month subscription (Personal or Pro). After the initial 12 months the subscription continues without commitment and can be cancelled at any time.
Prices and tier features are listed on the Pricing section of the homepage. All prices are excluding VAT unless stated otherwise. Currency: euros (€).
4. Order & payment
- Orders are placed through the onboarding flow on this site, which redirects to Stripe Checkout.
- The contract is formed once Stripe confirms successful payment.
- Payments are processed by Stripe Payments Europe Ltd. We never see or store your card details.
- An order confirmation is sent to the email address you provided. Keep it: it is your proof of purchase.
5. Delivery
Hardware is shipped within 5 business days from the order date, by carrier of our choice. Risk passes to you on delivery. We currently ship to mainland France and EU member states; other destinations on request.
6. Right of withdrawal
Consumers based in the EU have 14 days from delivery to withdraw without giving a reason, in line with article L221-18 of the French Consumer Code. The hardware must be returned in its original condition. Return shipping is at your charge unless the product is faulty. The withdrawal form is available on request at antoine@oria-marine.com.
Business buyers (B2B) waive the right of withdrawal for hardware that has been installed on a vessel.
7. Warranty
- Legal warranty of conformity (articles L217-3 et seq. of the French Consumer Code) — 2 years from delivery.
- Warranty against hidden defects (articles 1641 et seq. of the French Civil Code) — 2 years from discovery of the defect.
- Manufacturer warranty: the Oria Box is warranted free of manufacturing defects for the duration of an active subscription.
8. Subscription cancellation
After the initial 12-month commitment, you can cancel the Personal or Pro subscription at any time from your account or by emailing antoine@oria-marine.com. Cancellation takes effect at the end of the current billing month. After cancellation you keep read-only access to your past sessions for 6 months. The hardware remains yours and can be reactivated later.
9. Liability
Oria is liable for the proper performance of its obligations under these terms, subject to the limitations set by French law. Oria is not liable for indirect or consequential losses, including loss of profit, loss of data, or impossibility to use a vessel for any reason not directly attributable to the Oria service. Oria's total liability is capped at the total amount paid by you over the 12 months preceding the event giving rise to the claim.
The Oria service is an aid to monitoring and replay. It is not a navigation system, not a safety system, and not a substitute for the captain's judgement and the equipment required by maritime regulation. The captain remains responsible for navigation at all times.
10. Acceptable use
You agree not to use the site or the service in a way that is illegal, infringes third-party rights, or attempts to disrupt the service. We may suspend an account that violates these rules, with prior notice where reasonably possible.
11. Intellectual property
All software, content and trademarks on this site and in the Oria service are the property of Oria Marine or its licensors. Your subscription grants you a personal, non-exclusive, non-transferable right to use the service. Data you generate (sessions, maintenance log) remains yours; we hold a limited licence to host and display it back to you.
12. Dispute resolution
We try to resolve every issue directly — please write to antoine@oria-marine.com first.
If a dispute persists, consumers may refer the matter free of charge to CMAP — Centre de Médiation et d'Arbitrage de Paris (39 avenue Franklin D. Roosevelt, 75008 Paris — www.cmap.fr — consommation@cmap.fr), in line with article L612-1 of the French Consumer Code.
Failing amicable resolution, French courts have jurisdiction. The competent court for B2B disputes is the Tribunal de commerce de Paris.
13. Changes to these terms
We may update these terms. The version applicable to your subscription is the one in force at the start of the current billing period. Material changes are notified by email at least 30 days in advance.
